Declaration of Mutual Care and Personal Responsibility

I certify that I am at least 18 years of age. I have read and understand this document and the rules it contains. I understand that my attendance at this event is voluntary and for my personal spiritual practice, enjoyment and education only and does not require me to interact with any persons without my explicit consent. I understand that any interactions I initiate with any other participants without their explicit consent may result in my own expulsion from the event. I agree to abide by and follow all of the instructions posted or given to me by the event officials and agree to inform the host of any unsafe or illegal conditions I observe.

I understand that the NCNW Camp will offer a variety of activities that can be physically, mentally, and emotionally challenging. The level of my participation in any of the activities is at all times completely my choice. I may stop or say “no” at any time. In the event of an emergency, I give the NCNW Camp staff permission to call an ambulance or physician. This release also applies to the minors listed on this registration form for whom I am responsible.

I HEREBY RELEASE AND HOLD HARMLESS AND INDEMNIFY NCNW, THE EVENT PLANNERS, FACILITATORS AND VOLUNTEERS, AND THE WINDWARD EDUCATION & RESEARCH CENTER FROM ANY AND ALL LIABILITY, INCLUDING ANY LEGAL OR FINANCIAL OBLIGATION TO ME, RESULTING FROM ANY CONSEQUENCES OF MY HAVING ATTENDED THIS EVENT, including any consequences to my welfare, physical or psychological, that may arise from my use of the space provided for this event, or from my participation in any activities or interaction with other individuals at this event, including but not limited to, claims based on negligence, breach of implied warranty, or any other tort liability. I agree that in the case of a dispute over the terms of this waiver, express or implied, any tort action or other cause of action whatsoever, that the venue for any litigation shall exist solely in King County, WA. I also agree that any dispute, whether in the courts or otherwise, shall only apply Washington law. In the event that NCNW, the event planners, facilitators and volunteers, and the Windward Education & Research Center are found liable to me for any reason whatsoever, that said liability is limited to $50 or my admission fee, whichever is less. Furthermore, I declare that I am not acting in the capacity of a reporter or agent of any form of news media.

Windward’s General Release of Liability


This agreement is between the Windward Foundation, Inc., the Windward Education and Research Center, Inc. (“Windward”) and the below named party who hereby acknowledges that Windward is located in Wahkiacus, Washington, and situated on rough, forested terrain.

Windward is involved in the activities of both a working farm with assorted animals, livestock, pens, sheds and outbuildings, and a construction site with buildings and projects in various stages of completion, with lumber, tools, equipment and light and heavy machinery.

I acknowledge the inherent dangers of these conditions and activities and have made a voluntary choice to participate despite those hazards. In consideration therefore, I agree to assume any and all risks of injury which might be associated with or result from my participation.

I further release, waive, discharge and covenant not to sue Windward, its officers, agents, or members from all liability to me, or any other party claiming an interest through me, for all loss or damage or demand therefore on account of injury to my person or property, whether caused by their negligence or for any other reason, while participating in activities at Windward.

In the event of a dispute between the parties arising out of my participation in any Windward activity, I agree to work through Windward’s internal dispute resolution procedures. If these procedures do not lead to the resolution of the dispute, the parties agree to submit it to binding arbitration before a mutually acceptable magistrate in Klickitat County. The arbitration may take place wherever the parties mutually agree, but will be at Windward if they do not agree otherwise, and in any case the laws of the State of Washington will apply. During arbitration, either party will be entitled to discovery pursuant to the procedures available in litigation in Washington.

It is the intent of the undersigned that the above Release be as broad and inclusive as allowed by law. If any portion is invalid, the remainder shall continue in full force and effect. I have read and understood this Release and all its terms. I warrant that the above is true and correct in all respects and that no oral representations, statements or inducements apart from the foregoing have been made.
